Definition

“Claims” means any past, present or future, actual or contingent, claim, cause of action, complaint, liability, cost or expense that You have, had, may or might have in connection with or arising in any way in relation to Us, this programme or the use of the information contained within regardless of whether the fact, matters or circumstances giving rise to that Claim are known to You or any other person at the date of viewing this programme or relying on the contents therein;

“Us” means Hardgainer Fitness including our agents, contractors and employees;

“We” means Hardgainer Fitness including our agents, contractors and employees;

“You” means any and all users of this programme.

Terms

By following any of our programmes You agree to be bound by the terms and conditions set out on this page.

These programmes are intended for people 18 years of age or older. If you are not 18 years of age or older you should not be using any of our programmes.

You agree to follow the programmes in a safe and professional manner.

You acknowledge that when participating in any exercise or exercise programme that there is the possibility of physical injury, or death.

By using our programmes, You expressly acknowledge and agree that You:

a) do so voluntarily and at your own risk and liability; and

b) assume all risk of injury to You.

We will not be liable to You or relations in any way in relation to the contents of, or use of, or otherwise in connection with, our programmes or the information contained in it, whether for negligence or any other cause of action. You exercise at your own discretion and accept any injury or illness brought on by exercise is your own responsibility.

You release Us from and indemnify Us against any and all Claims.

You agree that You will not bring any Claims against Us.

We are not medical practitioners or dietitians. We strongly recommend that prior to commencing any diet or exercise regime that You consult a medical practitioner and/or dietitian, especially if you have any dietary related conditions. In the event of such conditions the meal plans in our programmes may not be suitable and an alternative solution should be discussed with your dietitian.

We have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise or diet on a medical condition.

You should have completed a basic introductory session with one of the fitness staff at your gym, followed by further sessions (as necessary) to ensure that You understand the equipment and how to use it safely.

Before exercising make sure you have warmed up well by warming up the respiratory system, along with muscles and joints being used in your current exercises.

To minimise the risk of injury You must use correct exercise form and be aware of your surroundings where there may be hazards that can cause injury and accidents.

Throughout the exercises You must wear appropriate gym attire and foot wear.

If you feel dizzy, faint, unwell or feel any unusual pain then you must stop exercising immediately and seek medical advice from your General Practitioner.

You acknowledge the results from your programme are not guaranteed and these results can be impacted by many factors, including and not limited to: how well you follow the programme, your own genetics and lifestyle, and environment. Everyone is different, and therefore will see different results from the same programme.
